Why Do Cosmetic Manufacturers Need a License?

Under the Drugs and Cosmetics Act, 1940, cosmetics manufactured in India require a license from the State Licensing Authority. This applies to manufacturers of shampoos, creams, lotions, lipsticks, perfumes, hair dyes, sunscreens, toothpastes, and all other products classified as “cosmetics” under the Act. Manufacturing cosmetics without a license is a punishable offense under Section 33E.

What Products Are “Cosmetics” Under Indian Law?

The Drugs and Cosmetics Act defines cosmetics as any article intended for application to the human body — including toiletries, skin care, hair care, oral care, and color cosmetics — excluding items classified as drugs (e.g., medicated shampoos or fluoride toothpastes may be drugs, not cosmetics).

Document Requirements for Cosmetic Manufacturing License

  • Application in prescribed format to State Licensing Authority
  • Premises documents (ownership or registered lease)
  • Site plan of manufacturing facility
  • Product formulation list with INCI names and percentage compositions
  • Technical person qualification and appointment letter
  • Manufacturing processes and equipment list
  • Stability data for the products (as required by state authority)
  • GMP compliance declaration

Cosmetic Loan License

If you do not own a manufacturing facility, a cosmetic loan license allows your brand to manufacture at a licensed third-party facility. DK Reg Compliance manages coordination with the contract manufacturer (lender) and prepares the loan license application on behalf of the brand.
