State FDA Approval in India: What It Covers and How to Get It

What Is the State FDA?

The State Food and Drug Administration (State FDA), or State Licensing Authority (SLA), is the regulatory body at the state level responsible for enforcing the Drugs and Cosmetics Act, 1940 within that state. Each Indian state operates its own SLA — such as Maharashtra FDA, Delhi Drug Control Department, Uttar Pradesh FSDA, and Karnataka Drugs Control Department — while enforcing national statutory rules.

What Does State FDA Regulate?

  • Retail drug licenses (pharmacies, medical stores, hospital dispensaries)
  • Wholesale drug licenses (pharmaceutical stockists, distributors, C&F agents)
  • Drug manufacturing licenses (allopathic, Ayurvedic, homeopathic production units)
  • Cosmetic manufacturing licenses (shampoos, creams, color cosmetics, toiletries)
  • Class A and Class B medical device manufacturing licenses
  • Drug testing laboratory licenses and contract/loan manufacturing licenses

How State FDA Requirements Differ Across States

While the statutory provisions of the Drugs and Cosmetics Act apply uniformly across India, operational procedures differ significantly between states:

  • Online Portals: Maharashtra uses XLN portal; Delhi uses single-window state portals; UP and Karnataka have their own localized interfaces.
  • Premises Area Norms: While central guidelines recommend 10 sq metres for retail/wholesale, states like Maharashtra strictly mandate 15 sq metres for wholesale setups.
  • Inspection Rigor & Timelines: Physical inspection scheduling and query turnarounds vary from 30 days in fast states up to 90 days depending on local authority workloads.

How to Navigate State-Level Compliance Successfully

The most reliable way to obtain State FDA approval without rework is to work with regulatory specialists who understand the exact regional checklists, local language affidavits, and technical expectations of the specific state authority where your premises are located.
